As Senior Counsel for Licensing & Enforcement, Brad helps music services that rely on the government’s statutory license (administered by SoundExchange) to fulfill their obligations under the law. That means making sure services pay royalties and report playlists accurately and on time, as well as working with start-ups and small stations to meet the license’s requirements. Brad also helps manage royalty rate-setting proceedings and advises internal departments at SoundExchange on how to implement the statutory license’s regulations. Prior to joining the SoundExchange legal team, Brad was an associate at Sutherland Asbill & Brennan, where he focused on copyright and trademark matters. Brad graduated from the University of Notre Dame in 1998, where he was editor in chief of the student newspaper, and the University of Virginia School of Law in 2004, where he was editor in chief of the Virginia Journal of Law & Technology.

Ken Steinthal is a partner in the Intellectual Property Practice in King & Spalding’s San Francisco office. He litigates matters in the IP/media sector, before trial and appellate courts and copyright tribunals in the United States and internationally.

Ken’s practice is focused on copyright, DMCA safe-harbor and antitrust/rate-setting cases involving the distribution of music and audiovisual content, often involving the establishment of structures and rates for the exploitation of musical works and sound recordings in both traditional and new media distribution environments. In the last two years, Ken has led the recent trial and related court proceedings on behalf of Pandora against ASCAP and BMI, which proceedings have resulted in much-publicized Department of Justice investigations of ASCAP/BMI and their consent decrees. He also is representing NPR in the ongoing “Web IV” proceedings to establish rates and terms for webcasters for the statutory license term 1/1/2016 – 12/31/2020. And he is lead counsel defending a group of defendants (Amazon, Microsoft, eMusic, Apple, Google and The Orchard) in a putative class action alleging systemic failures to clear mechanical rights associated with the sale of downloads in the United States.

Beyond managing these and a number of prior and ongoing media industry litigations, Ken and his team have a robust practice counseling clients engaged in content distribution regarding the copyright risks and implications of their potential and existing product offerings.
